These terms and conditions form the basis on which you can visit us and our website.  Please read them carefully as they contain important information.

General terms and conditions

This site is owned and operated by The Wallpaper Hut Ltd of 29 Caldecote Gardens, Bushey Heath, Hertfordshire, WD23 4GP. If you have any queries about these terms and conditions or if you have any comments or complaints on or about our website, you can contact us at contact@thewallpaperhut.co.uk

Where we refer to “Consumer” below we mean an individual acting for purposes which are wholly or mainly outside that person’s trade, business, craft or profession.

Where you communicate with us on behalf of a company / organisation, you promise that you have authority to act on behalf of that entity.

We may change these terms and conditions at any time. Please check them carefully as they will apply to anything you buy after the effective date shown at the top.

1.         The contract between us

We must receive payment of the whole of the price for the services that you order before your order can be accepted. Payment of the price for the services represents an offer on your part to purchase the services, which will be accepted by us only when a confirmation of acceptance is sent by us.  Only at this point is a legally binding contract created between us.

Your order is an offer to buy from us (except as otherwise stated below).

When ordering via email, you place your order by using the contact@thewallpaperhut.co.uk email address. This involves selecting the goods after receiving the relevant samples, and confirming these with us.

You must ensure that your order (including delivery address) and any other information you supply to us is correct and that you tell us immediately if there are any changes.

You are not allowed to buy any goods via this site if your main purpose is to use them to infringe our intellectual property or other legal rights.

We accept your offer and there is a binding legal contract when we send you a confirmation email. However, if you order via email, our quote is an offer by us which you accept by making payment

We are not obliged to supply any goods which are unavailable, even if we have entered into a legally binding contract with you. We will notify you of the unavailability as soon as possible and will arrange for a full refund if you have been charged.

2.         Services

We will carry out the creative and design work (“Service") for you in accordance with the brief agreed between us (“The Brief”).         

We will perform the Service covering the matters and in the manner set out in the Brief.

This agreement/ Contracts may not be assigned to a 3rd party.

3.         Acknowledgement of your order

To enable us to process your order, you will need to provide us with your e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us.

4.         Differences in the Goods

You accept that most of our goods are dyed and that batches can vary slightly in colour and shade. Accordingly, we cannot guarantee that colour and shade of any goods will be identical to any previous order or to any sample or to the way that the goods are displayed on our website. (If you are in any doubt, please call our design team for further advice.)

You agree that our goods may contain natural flaws and imperfections and, if so, that does not mean that the goods are faulty.

You agree to check the product description for more details and to contact us for further information if anything is unclear.

5.         Quantities, Pastes & Care and Maintenance

You must ensure all wallpaper quantities are confirmed with your decorator prior to ordering.

The Wallpaper Hut recommends you allow extra wallpaper for any future remedial works. We cannot guarantee future stock, availability or batch numbers of wallpaper if required at a later date.

Where specific paste/adhesive is supplied by the wallpaper brand The Wallpaper Hut will specify this, otherwise the required paste will be detailed on the packaging and will be at the discretion of your decorator.

The Wallpaper Hut accept no liability for the application of wallpaper. Wallpaper must be hung in accordance with each manufacturers guideline. Prior to hanging any wallpaper, if additional, specific instructions are required for the application of any wallpaper please contact The Wallpaper Hut and we can obtain information from the manufacturer.

Please refer to the manufacturers guideline for care and maintenance of your wallpaper.

6.         Ownership of rights

All rights, including copyright, in this website are owned by or licensed to The Wallpaper Hut. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

7.         Accuracy of content

We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all services have been described accurately.

8.         Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

9.         Availability

The services will be provided within an agreed timescale, and time is not of the essence of the contract.

10.       Ordering errors

You are able to correct errors on your order up to the point on which you make payment for the goods during the ordering process.

11.       Price

The prices payable for services that you order are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at the time of entering information.

Our fees for the Service shall be specified as per The Wallpaper Hut website. These fees are to be paid in cleared funds prior to the commencement of works.

Our prices may change from time to time. The price for the goods you order is as stated on our quote at the time you send us your order. Any applicable VAT or sales tax is included in any price shown.

Delivery costs are charged extra at the rate shown on your invoice at the time you place your order. These will depend on the delivery method chosen. NB Unless we say otherwise, delivery charges do not include customs or import duties which may be applied to your order by the relevant authorities. We have no control of these, and it is your separate responsibility to pay for them. We recommend that you check with your local customs office in advance.

If we have mis-priced any item by mistake, we are not obliged to supply the item at that price provided we tell you before we send it off. If we do, then you can decide if you want to order the item at the right price but, if you do not, we will provide a full refund of any payments already made.

You agree to contact us immediately with full details if you dispute any payment.

12.       Payment terms

We will take payment upon receipt of your order via BACS transfer. We accept no liability if our services are delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the services from you, then we can refuse to process your order and/or suspend any further services. This does not affect any other rights we may have.

Payment is in advance by the means stated on our invoice.

We are entitled not to send off the goods until we have received full payment in cleared funds. All goods remain the property of The Wallpaper Hut until paid for in full.

13.       Delivery

Delivery will be complete when individual wallpaper brands deliver to the address which you specify when ordering. Wallpaper brands may deliver different parts of your order on different dates.

Delivery is only to the countries we specify on our website and is otherwise subject to any other delivery restrictions or requirements explained on our delivery page. We have the right to cancel any order from a country to which we do not deliver (even if there is a binding contract).

Unless otherwise stated, delivery dates given are estimates only. If you are a Consumer, we have no liability for any losses arising from delay in delivery (a) to the extent that this is due to circumstances beyond our reasonable control and where we could not have taken reasonable steps to deal with the delay or (b) if you haven’t given us adequate delivery instructions.

You agree to alert us in advance to any access restrictions.

If you receive notification of an unsuccessful attempted delivery, it is your responsibility to use the details provided to immediately contact the delivery company to arrange re-delivery. If the delivery company returns the item to the wallpaper brand because they have been unable to deliver it, we are allowed to cancel the contract, in which case we will refund the price paid but excluding the delivery charge.

If you have failed to comply with your obligations regarding delivery, we are entitled to abort delivery and you agree to pay us the amount of any delivery, storage, insurance or other costs that we incur. We are entitled to require that such costs be paid before we arrange re-delivery and/or add them to any future order you make and/or deduct them from any payment due to you (to the extent legally allowed).

If packaging appears damaged upon delivery please sign for on the carrier's delivery sheet as damaged or as instructed by the courier making the delivery. Wallpaper delivered directly from the supplier to the clients address must be checked for any damages and reported immediately within 24 hours to The Wallpaper Hut. Failure to do so, may result in individual wallpaper manufacturers, refusing to accept any returns.

You become owner of the goods after the later of delivery of the goods and payment of the price plus delivery charges. Until that happens, you hold the goods on our behalf.

Returns on standard products (sold per roll) are subject to each suppliers terms and conditions, restocking fees and return delivery costs will be applicable.

14.       Warranty & Returns

All warranties and returns are subject the terms and conditions of each individual wallpaper manufacturer.

15.       Cancellation

Once an order has been confirmed via cleared funds to The Wallpaper Hut, we are unable to make changes or cancel an order that has been dispatched.

16.       Cancellation by us

We reserve the right not to process your order if any amount due to The Wallpaper Hut is unpaid.

17.       If there is a problem with the service

18.       Liability

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions.  We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

19.      Intellectual property rights (IPR)

Your purchase of goods from us does not of itself give you the right to use or exploit any IPR comprised in or relating to the goods.

Competitors must not copy product images, descriptions or information for use when selling the same or other products.

20.       Events outside our control

We are not liable for failure to perform or delay in performing any obligation under this agreement if the failure or delay is caused by any circumstances beyond our reasonable control including third party telecommunication failures and epidemics/pandemics.

21.       Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

22.       Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

23.       Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

24.       Privacy

You acknowledge and agree to be bound by the terms of our Privacy Statement.
